These Terms of Service (“Terms”) govern access to and use of the Fotlum online store, products, website, and related services.

By using our store or placing an order, you agree to these Terms. If you do not agree, please do not use our services.

1. Eligibility and Lawful Use

You must be at least the age of majority in your place of residence or use the store with the permission and supervision of a parent or legal guardian.

You may not use the store for unlawful, fraudulent, abusive, or unauthorized purposes or interfere with its operation or security.

2. Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, measurements, colors, features, prices, and availability.

Actual colors or minor product details may vary because of screen settings, lighting, production batches, manufacturing tolerances, or product updates.

A variation that materially affects the product will be handled under our Return and Refund Policy and applicable law.

3. Prices and Payments

Prices are displayed in the currency shown on the store and may change without notice. Changes will not normally affect an order already accepted.

Taxes, shipping charges, duties, or other applicable charges will be displayed at checkout when available.

You agree to provide accurate and complete billing, shipping, contact, and payment information.

Payments are processed through authorized third-party providers. We do not directly store complete payment-card information.

4. Order Acceptance

Submitting an order constitutes an offer to purchase. An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.

We may cancel or limit an order for legitimate reasons, including:

• Product unavailability;
• Obvious pricing or description errors;
• Suspected fraud or unauthorized payment;
• Shipping restrictions;
• Inaccurate customer information; or
• Legal or regulatory requirements.

If we cancel a paid order, the applicable amount will be refunded to the original payment method.

5. Order Processing and Shipping

Orders are normally prepared and dispatched within 7–15 days after the order is successfully placed and payment is confirmed.

This period covers processing and dispatch only. It does not include carrier transit time.

Transportation and delivery times depend on the carrier, destination, customs processing, local delivery conditions, weather, and other circumstances. Unless expressly stated otherwise, all delivery timeframes are estimates and are not guaranteed arrival dates.

The final arrival time is based on actual carrier progress. Additional information is provided in our Shipping Policy.

Nothing in this section limits customer rights that apply when an order is not delivered within a reasonable period under applicable law.

6. Returns and Refunds

Eligible return requests may be submitted within 30 days after delivery.

We do not maintain a single public return address. Customers must contact openseaaccount@gmail.com and obtain written authorization, the correct return address, and return instructions before sending any product.

The business address displayed on our website is not a return warehouse unless specifically authorized for a particular return.

Returns, refunds, exchanges, damaged products, and cancellations are governed by our Return and Refund Policy.

7. Intellectual Property

The store and its content—including text, graphics, photographs, logos, designs, layouts, and software—are owned by or licensed to Fotlum and protected by applicable intellectual-property laws.

Store content may not be reproduced, distributed, modified, published, sold, or commercially exploited without prior written permission, except as permitted by law.

8. Customer Submissions

If you submit a product review, photograph, suggestion, or other content, you confirm that you have the right to provide it and that it does not violate another person’s rights or applicable law.

You grant Fotlum a non-exclusive, worldwide, royalty-free license to use and display that content for operating and promoting the store, subject to applicable privacy and consumer laws.

We may remove content that is unlawful, deceptive, abusive, infringing, or otherwise inappropriate.

9. Third-Party Services

Our store may use services provided by third parties, including Shopify, payment processors, analytics providers, and carriers.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for independent services outside our reasonable control, but this does not exclude responsibilities imposed on us by law.

10. Prohibited Conduct

You may not:

• Use the store for unlawful or fraudulent purposes;
• Submit false or misleading information;
• Violate intellectual-property, privacy, or other legal rights;
• Introduce malware or harmful code;
• Attempt unauthorized access to the store;
• Interfere with website security or operation; or
• Evade payment, fraud-prevention, or purchasing controls.

11. Service Availability

We make reasonable efforts to keep the store available and accurate. Temporary interruptions may occur due to maintenance, technical issues, security concerns, or events outside our control.

We do not guarantee uninterrupted access, but we will not use this provision to exclude legal responsibilities that cannot be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, Fotlum will not be liable for indirect, incidental, special, punitive, or consequential loss resulting from use of the store.

This limitation does not apply to fraud, willful misconduct, or liability that cannot legally be excluded or limited.

Nothing in these Terms excludes mandatory warranties, guarantees, remedies, or consumer rights.

13. Governing Law

These Terms are governed by the laws applicable in the State of Colorado, United States, without regard to conflict-of-law principles.

Customers continue to receive any mandatory consumer protections available under the laws of their usual place of residence.

14. Changes to These Terms

We may update these Terms to reflect operational, legal, or regulatory changes. Updated Terms will be posted on this page with a revised date and will apply prospectively unless otherwise permitted by law.

15. Severability

If any provision is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
